Ref: - Your office letter No, (H)/31/90. dt. 11.1.1990.
With reference to the letter cited and with further reference to the discussions Sri P.S.N.Murthy, incharge Asst. Labour Office, Rampachodavaram had with you on 17.1.1990. I submit that as per the Contract Labour (R&A) Act 1970 all contractors who undertake to produce a given result for the establishment through contract labour or who supplies the contract labour should be. Licensed by this Department with the Licensing Authority and Asst. Commissioner of Labour, Rajahmundry . The Principal Employer for whom the work is done Viz. (1) A.P.P. Mills Ltd., Rajahmundry should also get it self registered as a Principal Employer with the Registering Authority and Asst. commissioner of labour, Rajahmundry . In the absence o such registration or license the workmen will be deemed to be the direct workmen of the principal employer as per the settled legal position.
As per our records, there was no contractor licensed either on behalf of the Forest Department or in respect of the A.P.P. Mills workmen at Geddada or Vedurnagaram as such the workmen are direct employees of the A.P.P. Mills and the Forest Department of Government of Andhra Pradesh respectively. While the employees of the Forest Department are governed by the minimum wages Act, the employees of A.P.P. Mills are entitled between the management and the union, in-as-much as that agreement provides for higher rate of wages than the wages fixed under minimum wages Act.
Since there are less payments than those notified under minimum wages Act the A.P. forest maistries Sangham, Rampachodavaram filed the claim petition before the court of Authority under minimum wages Act and Asst. Commissioner of Labour, Rajahmundry and the matter is subjudice. If there are less the employees or Asst. Labour Officer or the Trade union can file a claim before the Authority under minimum Wages Act and Asst. Commissioner of Labour, Rajahmundry . If there are less payments than those specified in the bilateral agreement the workers or there union or the Asst labour officer can file a claim before the authority under Payment of Wages Act and Asst. Commissioner of Labour, Rajahmundry .
I understand from the Asst. Labour Officer, Rampachodavaram who attended the meeting before you that you propose to inspect the aforesaid places and he is being instructed to accompany you, since he is notified as Inspector under Minimum wages Act and the payment of wages Act and can file claims of there are any statutory contravention. The Asst. Labour Office, Addateegala is also being instructed to inspect Vedurunagaram and furnish a report to you under copy to the undersigned.

Sir,
Kindly refer to your letter No. C/2664/89 dt. 17.1.90 on the above subject. The Central Industrial Relations Machinery officers (Central Government) Enforce applicable labour laws in the Literate mines. Under the Minimum wages Act. Literate mines have been brought under scheduled Employment and minimum rates of wages have been fixed. The present rate of minimum wages fixed for literate mining workers are as under:
For the work above ground for the work below ground
Unskilled Rs. 15-30 Rs. 18-45
Semi skilled. Rs. 19-05 Rs. 22-85
Skilled . Rs. 23-75 Rs. 28-15
Exclerical. Rs. 23-75 Rs. ---------
A part from the Minimum rates of wages payable, the workers are also entitled to get spl. Allowance fied basing on he averaged consumer prise index by the chief Labor Commissioner (Central). New Delhi for every six months ending 1 st Oct, and 1 st April, the present Spl. Allowance rate applicable in he mines are given as under:

Semi skilled. Rs. 1-76 Rs. 2-10
Skilled. Rs. 2-10 Rs. 2-62

Welfare amenities provided under labor laws are also being enforced to the mines by the above prices.
